So I am a software engineer and I started working at a terrible company about 6 months ago. 2 weekgs ago we had a deadline that while leading up to it I was "Coerced" or "Strongly advised not to stop until done". This lead to 6 hours of sleep in 5 days with the last 35 hours having no sleep. I quickly spiraled into a mixed episode and was hsopitalized after trying to commit suicide by overdose and driving into a telephone pole at over 100 mph.

Now I am out awaiting an intensive outpatient program that I desperately need and will most likely be remanded into if I opt not to go and my employer wants answers.
They have no short term disability, and my boss is "Very concerned that they were not made aware of any medical conditions I had during the hiring process"
I know if I tell them what happened I will get fired, I dont know what to do.
I emailed from the ER ad said I was using 5 CTO days to go into the hospital.
I know, eff that job get a better one. But I am severely in need of that income. my finances are a mess.

What should I do, I feel like they are responsible for this, but my Workmand comp attorney is iffy on the validity becuase its not my first attempt and subsequent inpatient stay.

I'm so sorry you're hurting so much, jpb4815! I'm so sorry you're going through all of this! Unfortunately I don't have a lot of advice to give to you! Can you start looking for another job as soon as you get out? I feel like this job has definitely put too much stress on you and I'm not sure if continuing to work there may be the best option for you! I understand you need money, but you need to take care of yourself and your own health as well! Not to mention that if you keep feeling worse your medical bills may increase so that wouldn't be too much helpful either! I completely agree with what xxenigmaxx has already wisely suggested better than I ever could! He has given you lots of great advice! I'd suggest to talk to a lawyer about this and see how it goes from there if you can afford it and if you haven't already! I'm so sorry you're going through all of this! I hope things will get better soon for you! Please remember to take GREAT care of yourself! That's the most important thing that you can do! I hope your job will become a little bit less stressful or that you'll be able to find a much better, less stressful! Please let us know how it goes and keep us updated! We all care about you here! We all love you here! Feel free to vent and write here as much as you need and want! You know we won't judge you! I promise you that! Remember that we're here for you if you need it! Feel free to PM me anytime! Let me know if I can do something to help you! Wish you good luck! Let us know how it goes! I'm so sorry you have to deal with all of this

I don’t know the legal ramifications of this, but I would lie or be as evasive as possible. They are obviously in the wrong, but it doesnt sound like any good will come to you with the truth.

I am sorry you're in this situation. I wish I had some advice to share, but I am here to support you.

I don't think one must share mental health diagnoses in an interview. Honestly, I think if we all did, most of us would have that as an "x mark" by our names compared to a similar candidate without a mental illness. Sad, but too often true. You didn't know they would inflict such extreme deadlines. Or did you? If you did, it may be best to know this in the future before accepting a job offer. We have to ensure our protections along the way. I understand, though, that we don't all have room, financially, to be too choosy. Also, we all wish we could handle the same severe stress as others can more effectively.

I would definitely research what your rights and protections may be at your current job.

Since you have access to an attorney, I would ask them how to respond to ""Very concerned that they were not made aware of any medical conditions I had during the hiring process..."

It sounds illegal to me as well but I am not a lawyer. Fortunately you are in a field that is in good demand and once you are well again you can look for another job. I would be cautious about working those kind of hours again. When my son was interviewing we looked up most places to get reviews from workers and could get a heads up about what to look out for.

Read this article. Its exactly what you are asking.
Should You Disclose a Mental Illness During the Hiring Process? - #1 Mental Health Blog - Talkspace
Quote:
Americans With Disabilities Act
Regardless of whether you decide to disclose or not, the Americans With Disabilities Act provides protection for those with mental health issues.

The ADA was signed into law in 1990 and provides basic rights for workers with disabilities, including those with a history of psychiatric disability. It means “employers can’t take actions (such as failing to hire, demoting, or denying training opportunities) because they believe a qualified applicant or employee might have a psychiatric disability.”

The law also prevents potential employers from asking questions during an interview about physical or mental illness. You are not required at any point during the interview to disclose your illness history, nor on the job if you so choose. Be prepared though that an employer may ask about your ability to perform certain tasks that will touch on issues impacted by mental health, such as high pressure situations or conflict resolution.

Another provision covered by the ADA is the right to job accommodations as long as they don’t cause “undue hardship” for an employer. This could mean permission to work from home on some days or the need for a flexible schedule, for example. In order to gain accommodations, you do need to disclose some information about your health to your company. This does not need to be disclosed during the interview process, however, but at any point before there is an issue.

I'm not eligible for FMLA until I have worked there for 12 months
