In California it’s a felony for a psychiatrist to have sex with a client. That’s what I was told at the time. What are offending psychiatrists charged with?
A client is not considered able to give consent to a sexual relationship with their psychiatrist because of the power differential: Would psychiatrist/client sexual intercourse be legally considered rape, then? Or would it only be rape if the client says, ‘no?’ I’m trying to work this out in my head and it still doesn’t make sense to me. |

If there person is unable to say no without repercussions, then the yes becomes invalid.

It looks like the actual charge can vary by location...sexual assault, sexual exploitation, criminal sexual conduct.
